General conditions / Booking conditions

Via the online reservation portal www.sleep.ch, you can book holiday accommodation throughout Switzerland. The accommodations are proposed in close cooperation with various partners (tourist organisations, Interhome, etc.) and through individual hotels, holiday rental agencies and other private renters, registered directly on the site of www.sleep.ch. 

Sleep.ch provides the client with the following services, described in the present general conditions as well as in all contractual documents.

In every case, sleep.ch acts only as intermediary between the client and the relative service supplier / partner. The service provider / partner is responsible for all information concerning price and availability. 

The following important distinction must be observed:

(a) booking of accommodation of partners

For the booking of accommodation of partners (Interhome, tourist organisations, etc.) the contract is drawn up between the client and the partner.

• The booking conditions of the respective partner are legally binding.
• The booking conditions of the partner must be accepted during the booking process.
• The payment conditions are those of the respective partner.

(b) booking of accommodation of individual or private service provider

For the booking of accommodation of individual or private service providers, the contract is drawn up directly between the client and the service provider (SP).

General conditions for booking accommodation of individual or private service provider

The following conditions concern exclusively the « booking of accommodation of individual or private service provider » defined under point (b).

1. The function of sleep.ch

Sleep.ch provides the client with the following services, described in the present general conditions as well as in all contractual documents.

• Rental of holiday apartments or individual houses
• Reservation of hotel bookings

2. Price The prices indicated in

Swiss Francs on internet and in the booking confirmation are firm and include VAT. Sleep.ch, respectively SP, reserve the right to increase the prices in the case of increase or introduction – after the conclusion of the booking – of costs, charges, taxes and other transport costs.

All additional costs not included in the price are mentioned separately in the booking confirmation.

3. Payment conditions

The following payment conditions are applicable:

3.1 Means of payment

Sleep.ch adopts the means of payment as defined by the SP. The following possibilities are available:

• bookings with payment directly to the renter
• bookings with payment to sleep.ch (credit card or invoice)

3.2 Confirmation of the booking with payment directly to the renter

The payment of the total amount of the booking is made directly to the owner. The owner has the right, in the case of long term bookings, to ask for a deposit or even the total payment before arrival.

3.2 Confirmation of the booking with payment to sleep.ch

The payment is made to sleep.ch by credit card or on invoice. The details of our banking relation are indicated in the booking confirmation.

4. Change or cancellation of the contract by the client

The client can cancel his journey before the beginning of the journey. The notification of the cancellation becomes effective the day that sleep.ch receives it.
 

Changes or cancellations must be communicated in writing or by e-mail.
 

The client has the right to propose a replacement tenant or client on the same conditions as himself if he cannot be present himself.
 

If the client withdraws from the contract or if his replacement does not show up, sleep.ch will charge the following cancellation fees:

Hotels / Bed & Breakfast

• For bookings for 1-3 nights: all cancellations notified at least 2 days before the arrival date are free of charge. For all cancellations or any changes notified after this delay, or in case of no-show, one night will be charged.
   
• For bookings of 4 nights and more : in case of cancellation less than 7 days before the arrival date, 50% of the price of all the over-nights will be charged. For cancellations or changes after this delay, the total bill will be charged.

If the object rented can be re-rented, the cancellation costs already paid bx a client will be refunded to him. The handling cost is due by the client.

Holiday apartments / Holiday homes

• Up until 64 days before the beginning of the rental, 20% of the rental price will be invoiced,
  minimum CHF 100.-
• From 43 to 63 days before the beginning of the rental, 50% of the rental price will be invoiced,
  minimum CHF 100.-
• From 42 to 2 days before the beginning of the rental, 80% of the rental price will be invoiced,
  minimum CHF 100.-
• Less than 2 days or no-show, 100% invoiced

If the object rented can be re-rented, the cancellation costs already paid by a client will be refunded to him. The handling charge is due by the client.

Changes in general

In general, for each change (e.g. names or number of participants) sleep.ch charges a handling cost of CHF 20.- per case, as long as the change can be made.
For changes concerning the dates of stay or the object rented (change of booking), the cancellation charges as per point 4 are applicable, on the understanding that these changes cause minimal costs and expenses.

5. Late arrival, early departure

The client is responsible for his arrival. In the case of late arrival due to breakdowns and congestion of public or private traffic (including trains and planes), etc. or due to personal reasons, no refund can be demanded. In the case of early departure, the total amount is due.

6. Changes caused by sleep.ch

Before the conclusion of the contract, the services and prices announced can be modified. After signature of the contract, sleep.ch is entitled, in the case of unforeseeable or unavoidable circumstances – before and during the stay – to modify the services and to propose others in replacement.

In the case of force majeure, natural disasters or other reasons which prevent or threaten the execution of the contract, sleep.ch has the right to cancel the contract and refund the services which have not been used (all claims for damages are excluded).

7. Responsibility of the client and complaints

The client undertakes to treat with care the rented object and its contents. The client accepts the rules of the holiday home.

If shortcomings are noted on entry into possession of the rented object, they must be notified to the renter without delay. Otherwise, it will be assumed that the rented object was handed over in perfect condition.

The client is responsible for damage caused by himself or his guests. All damage must be notified as soon as possible, at the latest at the restitution of the rented object. Damage appearing after the restitution of the rented object can be charged to the client if it can be proved that he is responsible.

8. Animals

In hotels or holiday apartments with the symbol « No animals », domestic or other animals are not permitted.

9. Responsibility of sleep.ch

The contractual responsibility of sleep.ch concerning damages, apart from corporal damage (e.g. deficient services, insufficient fulfilment of the contract) is limited to the cost of the stay.

The responsibility of sleep.ch is not engaged when the fault or damage has been caused by the client, his travelling companions or third parties, when there is a case of absolute necessity or other unforeseeable and unavoidable circumstances in spite of the precautions taken, when the fault is due to a service provider or a co-proprietor, etc.

In the case of circumstances which cannot be influenced by sleep.ch, such as interrupted access, closed motorways, increased noise, electricity cuts, natural disasters, political unrest, strikes, opening hours of tourist facilities, as well as in the case of theft of valuable objects such as jewellery, cash, cheques, credit cards, furs, photographic and video equipment, etc., sleep.ch is not responsible. Circumstances of this kind do not give the client the right to cancel the contract, to demand a price reduction or to claim damages.

10. Court jurisdiction

As a general rule, Swiss law is applicable. The court jurisdiction is Aigle, Canton of Vaud, Switzerland.
